Terms of Use

These Terms of Use (the "Terms") set the conditions on which any person (a "User") may access vectisworkssystems.com (the "Site"), a website operated by Vectis Works (the "Company").

Accessing or using the Site constitutes acceptance of these Terms. A User who does not accept them must refrain from using the Site.

The Site gives information about the Company's services to manufacturers in shop-floor data, dashboards, software and automation.

No content on the Site constitutes an offer capable of acceptance.

Each engagement of the Company is subject to its own written contract, executed by both parties. Where that contract and these Terms are inconsistent, the contract prevails.

The Company may send email to professionals holding roles connected with its services.

A recipient may bring such emails to an end whenever they wish by sending a reply to any one of them.

The Company's handling of personal information is described in its Privacy Policy.

All dashboards, diagrams, charts, tag names and figures appearing on the Site, or within the Company's sample dashboard, are based on representative sample data and serve only to show the type of views the Company produces.

Such material does not reflect results achieved for any client and does not represent a commitment to any particular outcome.

Users shall use the Site lawfully.

Users shall not interfere with the operation of the Site, obtain unauthorized entry to the Site or its underlying systems, test the Site for security weaknesses, or harvest its content with automated tools.

All text, images, logos and other material on the Site are the property of the Company or of its licensors.

Users may display and print Site pages for their own business reference. Any other reproduction, distribution or use requires the Company's prior written consent.

Rights in deliverables produced for clients are determined by the relevant written contract.

The Site contains links to vectisworks.com and retrieves its font from Google Fonts.

Third-party websites and services are subject to their operators' own terms and policies, for which the Company accepts no responsibility.

The Site is made available on an "as is" and "as available" basis, and is intended for general information.

So far as applicable law permits, the Company excludes every warranty, whether express or implied, including any warranty of merchantability, fitness for purpose or non-infringement, and any warranty that the Site will operate without interruption or error.

Content on the Site does not constitute professional, engineering, legal or financial advice.

So far as applicable law permits, the Company shall have no liability for punitive, special, incidental, indirect or consequential damages, nor for loss of profit, revenue, data or opportunity, in connection with use of the Site.

The Company's total liability in respect of any claim connected with the Site is capped at one hundred US dollars.

Each User shall indemnify the Company and its agents, owners and team members, and hold them harmless, against all claims, losses and expenses, reasonable attorneys' fees included, that result from the User's misuse of the Site or breach of these Terms.

The law of the State of Tennessee governs these Terms, disregarding any conflict of law rules.

Disputes concerning these Terms or the Site shall be settled by binding arbitration seated in Nashville, Tennessee, and conducted under the rules of the American Arbitration Association, save where arbitration is not permitted by law.

Severability. Should any provision of these Terms prove unenforceable, every other provision continues in full force.

No waiver. A failure or delay in enforcing a provision does not waive it.

Entire agreement. These Terms, read together with the Privacy Policy, form the complete agreement between the User and the Company regarding the Site.

Revisions. The Company may revise these Terms, and the effective date at the head of this page identifies the version in force.
